How Arizona Classifies Drug Trafficking Conduct

Arizona doesn’t use the word “trafficking” in its statutes the way most people expect. Instead, the law targets specific conduct: selling, transferring, transporting for sale, or importing a drug into the state. Under ARS 13-3407, those actions involving dangerous drugs such as methamphetamine or PCP are charged as a class 2 felony. Comparable conduct involving narcotic drugs such as heroin or cocaine falls under ARS 13-3408, also at the class 2 felony level.

What makes these charges especially serious is the statutory threshold amount system established under ARS 13-3401(36). If the quantity involved meets or exceeds a defined threshold: one gram of heroin, nine grams of cocaine or methamphetamine, four grams of PCP, or two pounds of marijuana, the law presumes intent to sell. A conviction above that threshold means no probation, no suspended sentence, and no early release until the sentence is fully served, with only narrow statutory exceptions. Proximity to a school or prior convictions can push the penalty higher still.

When Arizona Cases Move to Federal Court

State charges can escalate to federal prosecution when alleged conduct involves large quantities, crossing state lines, or connections to an organized distribution network. Federal drug trafficking under 21 U.S.C. 841 carries a tiered mandatory minimum structure: five years at the lower tier and 10 years at the higher tier, depending on drug type and quantity, with the possibility of life imprisonment in the most serious cases. The federal system has no parole, and federal judges have limited authority to sentence below a mandatory minimum outside of narrow statutory exceptions.
