Murder Charges Under Arizona Law

Arizona law defines murder across two statutes, each carrying different elements and sentencing ranges. Understanding the charge filed against you shapes every aspect of the defense.

First-Degree Murder (A.R.S. 13-1105)

First-degree murder is a Class 1 felony defined as intentionally or knowingly causing the death of another person with premeditation. Arizona law doesn’t require extensive planning. First-degree murder charges can also arise under the felony murder rule. Second-Degree Murder (A.R.S. 13-1104)

Second-degree murder is a Class 1 felony that applies when a person intentionally causes death without premeditation, or recklessly engages in conduct that demonstrates extreme indifference to human life, resulting in death. It isn’t a capital offense, but the sentencing range is 10 to 25 years. Both first- and second-degree murder sentences are served day-for-day in Arizona, with no early release for good behavior.
