Conduct Covered by Arizona Drug Manufacturing Laws
Arizona law can treat cultivating marijuana, producing methamphetamine or crack cocaine, and possessing materials intended to produce illegal substances as manufacturing-related conduct. It prohibits knowingly manufacturing a dangerous drug or possessing equipment or chemicals for that purpose.
The governing statute depends on the substance and alleged conduct:
- Dangerous drugs: A.R.S. § 13-3407 addresses manufacturing offenses, including those involving methamphetamine.
- Narcotic drugs: A.R.S. § 13-3408 addresses narcotic-drug manufacturing.
- Prescription-only drugs: A.R.S. § 13-3406 covers prescription-only drug manufacturing.
- Marijuana: A.R.S. § 13-3405 applies to marijuana cultivation.
Manufacturing Charges & Related Drug Allegations
A manufacturing charge is distinct from an allegation that someone possessed or distributed a controlled substance. One case can include manufacturing alongside possession, distribution, or prescription-related allegations. Because each charge has its own legal elements, we assess what prosecutors must prove for every alleged offense rather than treating all drug allegations as interchangeable.
Sentencing & Fine Provisions
A.R.S. § 13-3407(F) states that a person convicted of manufacturing a dangerous drug, or of listed methamphetamine offenses, isn’t eligible for suspension of sentence, probation, pardon, or release from confinement until the court-imposed sentence has been served. Subsection H also requires a fine of at least $1,000 or three times the court-determined value of the drugs involved, whichever is greater, in addition to other penalties. The charges, evidence, prior record, and court decisions affect the consequences in an individual case.
